DMCA Policy

Brussel Sprouts Recipe respects the intellectual property rights of others and expects its users to do the same. This DMCA Policy outlines the procedures for reporting copyright infringement and for filing a counter-notification regarding material removed due to an infringement claim.

In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged infringement that are properly provided to our Designated Copyright Agent.

Filing a DMCA Infringement Notice

If you believe that your copyrighted work has been copied and is accessible on the Brussel Sprouts Recipe website in a way that constitutes copyright infringement, you may notify us by providing our Copyright Agent with the following information in writing:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
  3. Identification of the material that is claimed to be infringing and where it is located on the Brussel Sprouts Recipe website (e.g., direct URL to the specific recipe page or image).
  4. Your contact information, including your name, address, telephone number, and email address.
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Upon receipt of a valid notice, we will remove or disable access to the infringing material and take reasonable steps to notify the user who posted the allegedly infringing content.

Filing a DMCA Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you have the right to file a counter-notification. Your counter-notification must be a written communication provided to our Copyright Agent and must include substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., the specific URL).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Brussel Sprouts Recipe may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will promptly provide the complaining party with a copy of the counter-notification. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notification, at our sole discretion.

All DMCA notices and counter-notifications should be submitted via our Contact Us page, clearly stating "DMCA Notice" or "DMCA Counter-Notification" in the subject line.
